Gambling-addicted former NBA ref Timothy Donaghy has subpoenaed the ex-head of the FBI Gambino-crime-family squad in the hopes of getting a lighter sentence, The Post has learned.
Donaghy's firebrand lawyer, John Lauro, has taken the unusual step of issuing a subpoena to Phil Scala, whose squad headed up the Donaghy investigation, to testify about the extent of the ref's cooperation with the government, according to court filings.
Cooperating witnesses often get lighter sentences based upon how much they help investigators.
"We believe that Mr. Scala can provide additional information to the court in order to render an appropriate sentence in this matter," Lauro wrote.
